On a day like today, but 28 years ago, Mexico’s former presidential candidate, Luis Donaldo Colosio, was assassinated in Lomas Taurinas, Tijuana, Baja California. Mario Aburto was identified as the perpetrator of the murder, for which he received a 45-year prison sentence and is currently being held in the Federal Center for Social Rehabilitation No. 12 in Guanajuato.
However, the accused has claimed that he was tortured since the day he was arrested to plead guilty, as well as some members of his family. As a result, the National Human Rights Commission (CNDH) has warned that the investigation into this case has been manipulated and has asked the Office of the Attorney General of the Republic (FGR) to inquire into the alleged acts of torture against Aburto Martínez.
Therefore, on March 23, the CNDH warned that a legal battle will begin against the National Institute for Access to Information (INAI) for requesting that information about the case be disseminated, which could affect the interests of the accused and the guarantee of his human rights.
In addition, the National Commission announced that it lodged two appeals for the protection of information in its possession, since the accused has been classified as a victim because of a previously submitted Recommendation. In this way, he accused that the INAI “intends to put at risk a case that has not been solved,” they said.
They also warned that they will resort to amparos or other resources that are necessary to clarify the facts about the murder of Donaldo Colosio (former PRI candidate) and thus defend the rights of the victims, so the intervention of the Congress of the Union will also be requested.
Similarly, the CNDH noted that individuals have intervened in Recommendation 48VG/2021 with “clear political and commercial interests”, which could jeopardize the integrity of the victims. This recommendation was accepted in December 2021 by the FGR and by the Decentralized Administrative Body for Prevention and Social Readaptation (OADPRS).
On the other hand, among the points mentioned in that recommendation are acts of violation of human rights. And he pointed out that among the outstanding issues to be resolved is that Aburto Martínez be transferred to a prison close to his family (since 2022 was 28 years old since the accused has no contact with his relatives).
Finally, it should be noted that this Tuesday, March 22, a federal judge accepted the promotion of an amparo promoted by Aburto due to the alleged omission of the FGR’s failure to to investigate alleged acts of torture against them. However, the Second District Judge of Amparo in Criminal Matters did not grant the provisional suspension for the Federal Public Prosecutor’s Office to investigate his allegations.
Meanwhile, on 28 March there will be a resolution on the definitive suspension, while on 20 April it will be defined whether the promoted amparo is granted.
